GURUGRAM: A city-based businessman — Amit Kumar Garg — was booked on Sunday for an alleged GST fraud worth Rs 6.22 crore.

As per the complaint filed by the excise department, Garg allegedly claimed an input tax credit of Rs 6.22 crore in the name of his business — Mahadev Enterprise in Jacobpura. A copy of the complaint accessed by TOI states, “During the investigation by the excise official, it is found that Amit Kumar Garg, Proprietor of M/s Mahadev Enterprises, GSTIN 06BZCPG0264Q1Z8 has been found to be involved in fraudulent claim and utilisation of fake input tax credit without receipt and supply of goods resulting in loss of revenue to the state as well as central exchequer.”

The complaint further mentioned that Garg utilised fake input tax credit (ITC) for discharging output tax liability without actual payment of tax. “Garg has allegedly claimed ITC under the IGST Act and further issued fake tax invoices to the different dealers located within the state as well as outside the state,” the complaint said.

“Additionally, he has fraudulently obtained registration under the Haryana Goods and Services Tax Act, 2017 by means of fraud, wilful misstatement and suppression of facts in the name and style of M/s Mahadev Enterprise with the purpose of evasion Tax,” it added.

On the complaint of the excise taxation officer, an FIR has been registered under sections 406 (punishment for criminal breach of trust) and 420 (fraud) of the IPC at City police station.
